Illinois Wrongful Death Laws
In the tragic event that a family member dies as a result of someone’s negligence, the Illinois legislature has enacted two statutes to compensate the decedent’s loved ones for the decedent’s damages and their loss: the Wrongful Death Act and the Illinois Survival Act.
The Wrongful Death Act creates a cause of action for the benefit of the next of kin, who may include the decedent’s widow, surviving children, parents, or siblings. A wrongful death lawsuit is filed in the name of the representative of the estate of the decedent and the following damages may be recoverable:
- Medical bills
- Funeral expenses
- Loss of future income and benefits
- Loss of future inheritance
- Loss of parental guidance (if decedent has minor children)
- Loss of spousal companionship, protection and care
- Grief, sorrow and mental suffering of surviving spouse and next of kin
- Loss of companionship
- Mental anguish
Under the Illinois Survival Act, a decedent’s next of kin may recover financial compensation for the pain and suffering of the decedent suffered from the time of injury until the time of death. In order to recover decedent pain and suffering damages, the plaintiff must show that the decedent was alive and suffered for a period of time following the accident.
Types of Wrongful Death Lawsuits
Wrongful death lawsuits may be filed any time a person dies as a result of the negligent or intentional misconduct of another person. Some common types of wrongful death lawsuits include:
- Car Accidents
- Truck Accidents
- Motorcycle Accidents
- Airplane Crashes
- Bus Accidents
- Train Accidents
- Medical Mistakes
- Nursing Home Abuse or Neglect
- Construction Accidents
- Dangerous and Defective Products
- Dog Bites
Act Quickly to Protect Your Rights
Statutes of limitations restrict the amount of time during which a wrongful death lawsuit may be filed. In general, Illinois wrongful death lawsuits must be filed within two years of the date of the fatal event. Accordingly, it is important to act quickly to protect your rights and obtain the necessary evidence to support your legal claim.
