Illinois Workers’ Compensation Benefits

The Illinois Workers’ Compensation Act was passed to provide compensation to workers who are injured in an on-the-job accident or suffer work-related injuries. Workers’ compensation benefits are generally available to injured workers, regardless of who was at fault for the accident, but the amount of a workers’ compensation settlement depends on the extent of the injuries and the injured worker’s wages. Depending on the extent of the work-related injury, the Illinois Workers’ Compensation Act provides for the following worker’s compensation benefits:

  • Medical expenses
  • Temporary total disability (TTD) benefits equal to two-thirds of the employee’s average gross weekly wage, up to a weekly maximum payment amount, if the injured worker is unable to work while recovering
  • Permanent total disability (PTD) or permanent partial disability (PPD) benefits based on a percentage of the employee’s pre-injury wage, up to a weekly maximum payment amount
  • Vocational rehabilitation benefits

What to Do Following a Workplace Injury

If you were injured in an on-the-job accident or suffered a work-related injury, your employer is obligated to provide workers’ compensation benefits via its workers’ compensation insurance company. In order to receive benefits, however, you must promptly notify your employer of the accident or injury. In many cases, you will be required to see a doctor chosen by the employer or its insurance company. If your employer or its insurance company fails to provide workers’ compensation benefits, you may wish to file a claim for workers’ compensation benefits with the Illinois Workers’ Compensation Commission (IWCC).

Third-Party Lawsuits

Unlike personal injury damages, there are legal limits on the amount of workers’ compensation benefits that an injured worker can receive. While injured workers are generally prohibited from suing his or her employer, an injured may be entitled to personal injury damages from any negligent third-party. For instance, if you were injured in a construction accident as a result of defective equipment, you may be able to recover personal injury damages from the equipment manufacturer in addition to workers’ compensation benefits.
